Notes:
Booking Form:
Upon confirmation, a booking form must be completed and signed by the primary tenant. Copies of all guests' passports will be required upon confirmation. Should a booking form not be completed, we reserve the right to cancel the reservation.
Security Deposit:
The security deposit is payable 30 days before arrival. An invoice will be sent directly to the tenant for settlement. This deposit will be refunded into the tenant’s bank account within 20 working days of the departure date specified within the agreement.
Concierge Deposit:
This is applicable to all extra services booked, such as transfers, chefs, butlers, and activities. The concierge deposit will depend on the services requested.
Check-In Instructions:
Check-in is between 14:00 and 18:00. Should a late check-in be required, it will be considered on a request basis. A host will meet you at the property to hand over the keys.
Check-Out Instructions:
Check-out is anytime before 10:00. A host will assist you upon departure and collect the keys.
On-Site Assistance:
24-hour assistance is provided.
House Rules:
Guests are required to sign a booking form and pay a breakage deposit.
Suspensive Conditions:
This Agreement of Lease (the ‘Agreement’), comprising the completed Booking Form and these Terms and Conditions of Lease, shall have no force or effect until the booking deposit has been paid in full and has cleared in the agent's bank account. Final approval of the short-term lease must be given in writing by the owner, and the details of the booking must be confirmed by the agent in writing.
The following information must be supplied by the tenant to the agent:
- Full names of all occupants of the property as they appear on their respective passports
- Copies of the passports or ID documents of all occupiers
- Contact details
- Arrival and departure details or flight details where applicable
- A completed booking form signed by the tenant
Any amounts shall be deemed unpaid until such payment reflects in the agent's bank account. Until the Agreement of Lease becomes binding, the booking of the premises is not secured. Please note that all reservations are subject to final written approval by the owner.
Financial:
- All rates are in South African rand (ZAR).
- All payments must be made in South African rand (ZAR) via EFT transfer, net of bank charges, or via a secure payment link.
- Minimum stays of 3 to 14 nights are applicable throughout the year depending on the specific property and the season.
- Should the tenant pay for their reservation by credit card, the agent shall charge an additional 3.5% surcharge.
- Quotes are subject to change until the relevant deposit has been received; this includes quotes for services.
- Services are subject to availability.
Breakage Deposit:
- The tenant will be required to pay a breakage deposit into the agent’s bank account as per the quotation or invoice received.
- This deposit will be refunded into the tenant’s bank account within 20 working days of the departure date specified within the agreement, provided the property is returned in the same state it was handed over, at the agent's discretion.
- In the event of breakages or disputes, the agent may extend the 20-day refund period to resolve the matter in the best interests of the owner and the tenant.
Breakage and Damages:
- The tenant shall be liable to pay the owner for the cost of replacing or remedying any loss or damage (beyond normal wear and tear) to the property, the inventory, or any structural fittings or improvements.
- Any lost keys or remote controls not returned will result in the replacement of the locks and keys, for which the tenant shall be liable.
- All loss or damage to the premises and its contents will be charged at the fair repair or replacement cost.
- The tenant shall be liable to pay an administration fee of R700.00 per hour plus 15% VAT for the management of replacements, repairs, or lost items.
- The agent is entitled to recover such costs from the tenant, including by deduction from the breakage deposit.
- The tenant will be liable for any bookings lost due to repairs being conducted after their departure.
- The breakage deposit shall be refunded within 20 calendar days of departure, less amounts required to repair or replace items, pay expenses other than regular utility charges, or pay any fines levied for non-compliance with municipal bylaws.
Rental Payable:
- The rental is calculated per night as stipulated on the booking form.
- The lease commences at 14:00 on the commencement date and terminates at 10:00 on the departure date.
- If the tenant fails to vacate the premises by 10:00, they shall be liable for 50% of the nightly charge if they vacate before 14:00, or a full night's rental if they vacate after 14:00.
Use of Property:
- Only the maximum number of persons specified in the booking form may occupy or stay overnight at the property.
- No parties, corporate events, or social gatherings are permitted. If more than 20 guests are on-site, it is deemed an unauthorised party, and guests will be evicted immediately.
- No loud noise or music is allowed. Non-compliance will result in a R2,500 fine for every call-out.
- We reserve the right to evict guests immediately without a refund if a loud party is held or if guests cause a nuisance to the neighbourhood.
- Excessive noise may result in a penalty of R20,000, which may be deducted from the damage deposit.
- No extra services may be delivered at the property unless approved in writing by the agent.
- Laundry may not be done by on-site staff; additional charges apply if this rule is breached, and it is at the tenant's own risk.
- The tenant must comply with all laws, bylaws, and body corporate rules. A fine of R2,000 per incident applies for negligence or misconduct.
- No subletting, photography, or videography for commercial purposes is allowed. Photos or videos may not be shared on social media or in publications without prior written consent.
- Smoking inside is strictly prohibited. Furniture and assets may not be moved, except for minor items like dining chairs.
- The tenant must ensure the swimming pool is supervised by responsible persons at all times.
- Solar panels, generators, or alternative water supplies may not be installed without consent. If a generator is used for reasons other than load shedding, the fuel costs are for the tenant's account.
- Staff will have full access to the property at all times for daily checks.
- TSU protection services are allocated to each reservation.
Breach:
In the event of a breach of these terms, the agent or owner may evict the tenant and occupants immediately and claim costs or damages. The agent reserves the right to access the premises at any time during the lease without permission if there is a valid reason or incident.
Insurance:
The tenant shall, at their own cost, insure themselves and their invitees for the duration of the lease against loss, theft, injury, or medical expenses. The agent and owner rely on the tenant’s confirmation that such insurance is in place.
Death, Personal Injury, Damage, or Loss of Property:
The tenant and their invitees use the accommodation at their own risk. Neither the agent nor the owner shall be liable for any loss, death, or damage suffered during the occupation, whether due to negligence or otherwise. No claims may be made for intermittent failures in the supply of electricity or water. The agent cannot be held liable for property defects or wilful negligence by the owner.
Cancellation by the Owner:
If the property is sold or rendered unsuitable by force majeure, the agent will attempt to find similar alternative accommodation. If this is not possible, a refund of the deposits or a pro-rata portion of the rental will be provided. Neither the owner nor the agent shall be liable for further damages arising from such circumstances.
Jurisdiction:
This agreement is governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrate's Court.
Domicilium:
The tenant appoints the premises as their domicilium citandi et executandi for all purposes during the occupation period. All notices must be in writing.
General:
The booking form and terms and conditions constitute the entire agreement between the parties. No variations are valid unless in writing and signed. Any reference to the tenant includes all visitors and guests.
Concierge:
All concierge services are subject to a 15% mark-up. A concierge deposit of at least R30,000 is required, which will be used for requested purchases and services. Any remaining balance will be refunded within 20 working days of departure.
Know Your Guest:
We partner with Know Your Guest for guest screening. Before the booking begins, you must verify your details and pay a deposit waiver. Please complete this validation prior to check-in.
