Booking Form Requirements:
On confirmation, the primary tenant must complete and sign a booking form. Copies of all guests' passports are also required upon confirmation. We reserve the right to cancel the reservation if the booking form is not completed.
Security Deposit:
- The security deposit is payable 30 days before arrival, with an invoice sent directly to the tenant for settlement.
- This deposit will be refunded into the tenant's bank account within 20 working days of the departure date specified in the agreement.
Concierge Deposit:
This deposit applies to all extra services booked, such as transfers, chef, butler, and activities. The required deposit amount depends on the services requested.
Check-In Instructions:
- Check-in is between 14:00 and 18:00. Late check-in requests are subject to approval.
- A host will meet you at the property to hand over the keys.
Check-Out Instructions:
- Check-out must be completed before 10:00. A host will assist you on departure and collect the keys.
On-Site Assistance:

House Rules:
Guests are required to sign a booking form and pay a breakage deposit.
Suspensive Conditions:
This Agreement of Lease ('the Agreement'), comprising the completed Booking Form and these Terms and Conditions of Lease, shall only come into force once all the following conditions are met:
- The booking deposit has been paid in full and has cleared in the Agent’s bank account.
- Final approval of the short-term lease is given in writing by the Owner.
- The details of the booking have been confirmed by the Agent in writing.
- The following information has been supplied by the Tenant to the Agent:
- Full names of all occupants of the Property as they appear on their respective passports.
- Copies of the passports or ID documents of all occupiers.
- Contact details.
- Arrival and departure details, including flight details (where applicable).
- A completed Booking Form has been signed by the Tenant.
- The booking has been confirmed by the Agent in writing.
Any amounts shall be deemed unpaid until such payment is reflected in the Agent’s bank account. Until the Agreement of Lease becomes binding, the booking of the Premises is not secured by the Tenant. Please note that all reservations are subject to final approval in writing by the Owner.
Financial Terms:
- All rates are quoted in South African Rands (ZAR).
- All payments must be made in South African Rands (ZAR) via Electronic Fund Transfer (EFT), net of bank charges, or via a secure payment link.
- Minimum stays of 3 to 14 nights are applicable throughout the year, depending on the specific property and the season.
- Should the Tenant pay for their reservation by credit card, the Agent shall charge an additional 3.5% surcharge.
- Quotes are subject to change until the relevant deposit has been received; this includes quotes for services.
- Services are subject to availability.
Breakage Deposit:
- The Tenant will be required to pay a Breakage Deposit (as per the quotation/invoice received) into the Agent’s bank account.
- This deposit will be refunded into the Tenant’s bank account within 20 working days of the departure date specified in the Agreement, provided that the Property is, at the discretion of the Agent, in the same state as it was handed over to the Tenant on the Commencement Date.
- If any breakages occur or disputes arise, the Agent may extend the 20-day refund period to resolve the matter in the best interests of the Owner and the Tenant.
Breakage And/Or Damages:
- The Tenant shall be liable to pay the Owner for the cost of replacing or remedying any loss or damage (beyond normal wear and tear) to the Property, the Inventory on the Premises, or other structural fittings or improvements found anywhere on the Premises.
- Any lost keys or remote-control devices not returned will result in the lock and keys/remote control being replaced, and the Tenant shall be liable for such costs.
- All loss or damage to the Premises and/or its contents will be charged at the fair repair and/or replacement cost of such item.
- The Tenant shall also be liable to pay an administration fee of R700.00 per hour plus 15% VAT for the management of the aforementioned replacement, repairs, damages, losses, or lost keys.
- The Agent, on behalf of the Owner, shall be entitled to recover such costs from the Tenant, including by deduction from the Breakage Deposit.
- The Tenant will be liable for any bookings lost due to breakages or repairs being conducted after the Tenant has departed.
- The Breakage Deposit shall be refunded to the Tenant within 20 calendar days of the departure date or the date the Tenant and/or the Tenant’s invitees vacate the Premises (whichever is later), minus such amounts required to:
- Replace or repair missing, broken, or damaged items of whatever nature.
- Pay any expense (other than regular consumption charges for electricity and water, which are for the account of the Owner).
- Pay any fines or extra charges levied on the Owner for non-compliance with municipal laws and by-laws, as applicable.
Rental Payable:
- The rental payable for the Property is calculated per night's stay, as stipulated on the Booking Form.
- The Lease commences at 14:00 on the Commencement Date and terminates at 10:00 on the Departure Date.
- If the Tenant or their invitees fail to vacate the Premises by 10:00 on the Departure Date, the Tenant shall be liable to pay the Agent, for the account of the Owner, an amount equal to 50% of the nightly charge if the Premises are vacated before 14:00 on the Departure Date.
- If the Tenant fails to vacate the Premises before 14:00 on the Departure Date, the Tenant shall be liable to pay for one full night’s rental.
Use Of Property:
- No more than the maximum number of persons specified in the Booking Form may occupy or stay overnight at the Property.
- Only persons recorded in the Booking Form may stay overnight at the Property.
- No parties, corporate events, or social gatherings are permitted on the Property.
- If more than 20 guests are on-site, it is deemed an unauthorised party, and the contract will be terminated immediately, resulting in eviction with assistance from -appointed guards.
- Loud noises and loud music are prohibited. Failure to comply with noise rules will result in a R2,500 fine for every call-out to the property to warn and quiet the tenant, should excessive noise complaints be received from neighbours.
- Should it be determined that a loud party is being held or that guests are causing excessive noise and nuisance to the neighbourhood, we reserve the right to immediately evict guests, suppliers, or contractors with assistance from -appointed guards, with no refund of monies paid.
- Should inordinate levels of noise be heard from the property, a penalty of R20,000 may be imposed on the tenant and deducted from the damage deposit.
- No extra services may be delivered or performed at the Property unless such service providers have been appointed or approved in writing by .
- Laundry may not be done by on-site staff or housekeepers. Additional charges will apply if done, and items will be cleaned at the Tenant's own risk if damaged.
- The Tenant and all invitees must comply with all laws, by-laws, regulations, Body Corporate Rules, and any other applicable restrictions.
- The Tenant and/or invitees shall be fined R2,000 per incident for any negligence or misconduct.
- No subletting of the Property, in whole or in part, is allowed.
- Photography and videography, including both the interior and exterior of the property, are strictly prohibited.
- Any photos or videos of the property’s interior or exterior may not be shared or featured on social media or in publications without prior written consent from both the Agent and the homeowner.
- No commercial or illegal activity may take place on the Property.
- Smoking inside the Property is strictly prohibited and is only allowed in designated areas.
- No furniture or assets are allowed to be moved around within the property or off-site. Moveable furniture, such as dining chairs, may be moved.
- The Tenant and all invitees must behave in a manner considerate of others. Disruptive behaviour caused by loud music, late-night, or early-morning rowdiness shall not be tolerated. The Tenant undertakes to ensure that occupants and visitors do not cause any nuisance to neighbouring occupants.
- If there is an open swimming pool on the Property, the Tenant is responsible for ensuring that the use of the swimming pool is supervised at all times by capable, responsible people, and that persons unable to swim do not approach the swimming pool unsupervised.
- The Tenant and invitees shall not install or cause to be installed anywhere on the Property or the Building, without the written consent of the Owner, any solar panel, generator, or other device intended for the conversion of energy into electricity, nor any alternative piped supply of water to the Property.
- Should the Tenant use the generator on the property for reasons other than power outages (load shedding), the generator fuel costs will be for the Tenant’s account.
- Some areas/items, such as store rooms and server rooms, may be off-limits to the Tenant.
- The Agent, as well as the Owner’s staff, will have full access to the property at all times, and daily checks will be conducted.
- TSU protection services (Tactical Response and Security) is allocated to each reservation for the duration of the stay. Should the Tenant wish to have the application on their mobile phone, this must be communicated to the reservations team at least seven days prior to arrival.
- Should a legal dispute arise between and the Tenant, the legal fees incurred by will be billed to the Tenant.
Breach:
- In the event of a breach of any provision of these Terms and Conditions of Lease (clause 8 in particular), the Agent and/or the Owner shall have the right to cause the Tenant and all the Tenant’s invitees and other occupants to be immediately evicted and reserve the right to claim any costs of effecting such eviction and/or damages due as a result of such early eviction.
- Should there be an incident or valid reason for accessing the property, the Agent reserves the right to access the premises at any time during the period of the Lease without requiring permission or notifying the Tenant.
Insurance:
The Tenant:
- Shall, at the Tenant’s cost, insure the Tenant and the Tenant’s invitees for the duration of the Lease Period against loss, breakages, or theft of personal belongings, injury, death, and/or medical expenses.
- Confirms that the Tenant has or will have such insurance cover.
- Acknowledges that if the Owner and the Agent accept the Tenant’s booking, they do so relying on the terms of the Agreement of Lease, including the Tenant’s confirmation of insurance.
Death, Personal Injury, Damage Or Loss Of Property:
- The Tenant and/or invitees use the accommodation at their own risk. Neither , its agents, employees, contractors, or officers, nor the Owner of the Property, shall be liable for any loss, death, or damages which the Tenant or invitees may suffer as a result of any death, injury, theft, damage to property, accident, or any event whatsoever occurring during the occupation of the Property, whether resulting from (or its employees/contractors) or the Owner’s default, negligence, or otherwise.
- The Tenant and/or invitees shall have no claim against (or any of its agents, employees, contractors, officers), or the Owner in respect of any damage, loss, injury, or inconvenience suffered directly or indirectly as a consequence of a cessation (intermittent, temporary, or otherwise) in the supply of electricity and/or water to the Premises and/or the Building and/or the Property. The Tenant agrees that the Owner is not obliged to provide an alternative source of supply of electricity or water.
- The Tenant and/or invitees accept full responsibility for any accidents caused by or arising out of their own negligence, misuse of property, or failure to comply with applicable statutes and regulations.
- Given that the Agent is not the owner of the Property and is merely brokering and/or facilitating a service in its role as Agent, cannot be held liable for any defect of the Property or wilful negligence or default by the Owner.
Cancellation By The Owner And/Or :
- If the Property booked is sold or rendered unsuitable (which includes being partially or totally destroyed by an event of Force Majeure, such as but not limited to fire, flood, or civil unrest), the Agent shall notify the Tenant as soon as possible and shall make every effort to source alternative premises of a similar standard and price, if available.
- If similar properties cannot be sourced at a similar price or at all, the Agent shall refund the deposit or full payment of the Booking Deposit and/or the Breakage Deposit (whichever has been paid) prior to the occupation period, or a pro-rata portion of the Booking Deposit for the occupation period during which the Tenant is unable to occupy the premises, upon receipt of such refund from the Owner.
- Neither the Owner nor the Agent shall be liable for any damage or loss arising from the sale or the rendering uninhabitable of the Property as aforesaid.
- The costs of any such relocation and alternative accommodation arising from an event of Force Majeure will be for the Tenant's account.
- The Tenant shall hold the Agent and/or its agents, employees, and contractors harmless in the event of any cancellation or breach of the terms of this agreement by the Owner, and any claim in respect thereof shall be made directly against the Owner and to the exclusion of the Agent, its agents, employees, and contractors.
Jurisdiction:
- This Agreement and any further rules regulating occupation of the property shall be interpreted and governed in accordance with the laws of the Republic of South Africa.
- The Parties consent to the jurisdiction of the Magistrates' Court in terms of section 45 of the Magistrates' Court Act 32 of 1944.
Domicilium:
- The Tenant appoints, as their domicilium citandi et executandi for all purposes, the Premises during the occupation period, and otherwise the address set out in the Booking Form.
- All notices given to the Tenant during the occupation period shall be in writing and hand-delivered to the Premises, and otherwise sent by email or fax to the address set out in the Booking Form.
- All notices given to the Owner relative to the Booking Form or the Terms and Conditions of Lease should be in writing and hand-delivered to the Agent, or sent to the Agent by email or fax to the address and number appearing on the Booking Form.
General Provisions:
- The terms contained in the Booking Form and the Terms and Conditions of Lease cancel and supersede any prior agreement between the parties, verbal or otherwise.
- The Booking Form and the Terms and Conditions of Lease contain the entire agreement between the parties.
- No alteration, variation, or addition to the Booking Form or the Terms and Conditions of Lease shall be of any force or effect unless reduced to writing and signed by the parties to this agreement or their authorised representatives.
- No indulgence, leniency, or extension of time which any party may grant or show shall in any way prejudice such party or preclude it from exercising any of its rights in the future.
- Any reference to the Tenant in this Agreement shall include all visitors, guests, and invitees of the Tenant.
Concierge Services:
- All concierge services are subject to a 15% mark-up, which will be added to the final bill for all services arranged and purchased on behalf of the tenant.
- A concierge deposit of at least R30,000 is required for guests to use this service. This amount will be determined by the number of services required by the tenant and the length of stay.
- shall use this deposit for all purchases/services requested by the Tenant that are not included in the rental fee (e.g., transfers, activities, groceries, etc.).
- Should the deposit paid be insufficient or depleted, the tenant will be required to top up this deposit to proceed with further services.
- The concierge deposit, minus all deductions for purchases or payments made by on behalf of the tenant, will be refunded into the Tenant’s bank account within 20 working days of the departure date specified in the Agreement.
